Terms of Service

1. Acceptance of terms

By accessing or using AffiliPilot (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this requirement and that the information you provide is accurate and complete.

3. Account responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.
• You may not share your account credentials with third parties or resell access to the Service.

4. Subscriptions and billing

4.1 Plans

The Service offers a Free plan and paid plans (Starter, Pro, Agency). Features and limits for each plan are described on our Pricing page.

4.2 Billing

Paid subscriptions are billed in advance on a monthly basis via Lemon Squeezy. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until cancelled.

4.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date. No partial refunds are issued for unused time.

4.4 Price changes

We may change pricing with 30 days’ notice. Price changes will not affect your current billing period. Continued use after a price change constitutes acceptance.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Submit malicious, fraudulent, or deceptive affiliate links for monitoring
• Attempt to gain unauthorized access to the Service, other users’ accounts, or our infrastructure
• Reverse engineer, decompile, or extract the source code of the Service
• Use automated means (bots, scrapers) to access the Service without our prior written consent, except for the official REST API provided to Agency plan subscribers
• Upload or transmit malware, viruses, or harmful code
• Interfere with or disrupt the Service or its underlying infrastructure
• Use the Service to harass, abuse, or harm others

6. Affiliate disclosures

As a publisher tool, AffiliPilot helps you manage affiliate relationships. You are solely responsible for complying with all applicable laws and regulations regarding affiliate disclosures, including but not limited to the FTC’s Endorsement Guides in the United States and equivalent regulations in your jurisdiction. AffiliPilot provides a disclosure generator tool for convenience; use of this tool does not guarantee legal compliance.

7. Intellectual property

7.1 Our IP

The Service, including its code, design, logos, trademarks, and content (excluding user-generated content), is owned by AffiliPilot and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7.2 Your content

You retain ownership of the affiliate links, content briefs, and other data you submit to the Service. By submitting content, you grant us a limited, non-exclusive license to use, store, and process that content solely for the purpose of providing the Service to you.

8. Third-party services

The Service integrates with third-party platforms including affiliate networks, payment processors (Lemon Squeezy), and authentication providers (Google, Supabase). We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services is governed by their respective terms and policies.

9. Affiliate relationships

AffiliPilot may earn commissions when users click on or purchase through certain links on our website. This does not affect the price you pay. We disclose these relationships in accordance with FTC guidelines.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFFILIPILOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless AffiliPilot, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request a copy of your data within 30 days of termination by contacting support.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, unless otherwise required by applicable law in your jurisdiction.

15. Refund policy

Paid subscriptions may be cancelled at any time. Refunds are issued at our sole discretion on a case-by-case basis. To request a refund, contact support@affilipilot.io within 14 days of your charge. Refunds are typically processed within 5–10 business days.

16. Service level and availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance is performed during off-peak hours when possible. We are not liable for downtime caused by circumstances beyond our reasonable control, including issues with third-party providers (Supabase, Lemon Squeezy, Vercel).

17. Miscellaneous

• Entire agreement: These Terms constitute the entire agreement between you and AffiliPilot regarding the Service.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
• No waiver: Our failure to enforce any right or provision does not constitute a waiver.
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
